Complete Rules of the Free Game with No Purchase Necessary, Including Random Drawing "Music Month Contest - Facebook"

 

Participation in the Game implies the unreserved acceptance of these Rules in their entirety, without condition or reservation.

In the event that, after becoming aware of them, the participant does not accept the provisions, initial or modified, of these Rules, the Organizing Company invites the participant to promptly disconnect from the Game application.

ARTICLE 1. ORGANIZING COMPANY

BY GREVIN, a Swiss corporation, with a share capital of CHF 3,200,000, headquartered at Route de Fenil 2, – 1804 Corsier-sur-Vevey - Switzerland, registered with the Commercial Register of the Canton of VAUD under number CH-660-0618000-4, operator of Chaplin’s World Museum (hereinafter referred to as the "Park"), organizes, from 03/06/24 to 06/06/24 inclusive, 11:59 PM (Swiss date and time of connection prevailing) a free game with no obligation to purchase, called "[...]" (hereinafter the "Game").

The Game is neither organized, nor managed, nor sponsored by META PLATFORMS INC. (hereinafter "FACEBOOK") operating the Facebook social network (hereinafter "Facebook") so that Facebook's responsibility cannot be sought by the participants.

ARTICLE 2. GAME VALIDITY PERIOD

The Game is organized from 03/06/24 to 06/06/24, 11:59 PM, Swiss date and time of connection prevailing.

ARTICLE 3. ACCESS TO THE GAME

3.1 Participation in the Game is free and without obligation to purchase. It is therefore not conditioned on any purchase or expense by the participant.

3.2 The Game is offered only on the Facebook social network, on the official Page of Chaplin’s World Museum published by the Organizing Company (hereinafter the "Official Facebook Page of Chaplin’s World").

The Game is only accessible via the Facebook post published on 03/06/24 on the Official Facebook Page of Chaplin’s World (hereinafter the "Facebook Post(s)").

ARTICLE 4. GAME COMMUNICATION

The Game is announced on the following platform(s):

The Official Facebook Page of Chaplin’s World;

ARTICLE 5. PARTICIPANTS' CONDITIONS

5.1 The Game is open to any individual aged fifteen (15) or older, at the date of participation in the Game, residing in Switzerland. The participation of any minor in the Game implies that they have obtained the prior express authorization from their parents or the person vested with parental authority. The Organizing Company reserves the right to verify said authorization and to declare any participation null and void in the absence of such authorization.

5.2 To participate in the Game, the participant must:

have access (fixed or mobile) to the Internet network;

have a valid personal email address where they can be contacted for the needs of managing the Game, if necessary;

have a personal account on Facebook.

Individuals who do not have a Facebook account can create one according to Facebook's terms of use.

5.3 The following are expressly excluded from the Game:

employees of the Organizing Company and companies belonging to the group of the Organizing Company as well as the immediate family members of their respective families;

any person who has participated directly or indirectly in the design, organization, implementation, and/or management of the Game, as well as the immediate family members of their respective families.

ARTICLE 6. PARTICIPATION TERMS IN THE GAME

6.1 Game Participation Procedure

To participate in the Game, the participant must, between 03/06/24 and 06/06/24, 11:59 PM, Swiss date and time of connection prevailing:

log in to their personal Facebook account;

access the Official Facebook Page of Chaplin’s World via a connection to the Facebook network to access the Facebook Post;

leave a comment in the "comment" section of the Facebook Post;

if applicable, correctly answer the Game question in the Facebook Post in the "comment" section;

if applicable, perform the action requested in the Facebook Post in the "comment" section.

click the "publish" button before 06/06/24, 11:59 PM, Swiss date and time prevailing, to record their participation in the Game.

6.2 Conditions for Participation

6.2.1 Any participation in the Game is subject to strict compliance with the steps described in Article 6.1 and registering the participant's participation before 06/06/24, 11:59 PM, Swiss date and time of connection prevailing.

6.2.2 Only one participation is allowed per person and per household (same name, same first name, same postal address) for the entire validity period of the Game.

6.2.3 Only one email address per participant (same name, same first name, same postal address) will be admitted in the Game. It is strictly prohibited for the participant to participate in the Game using different email addresses.

6.2.4 Participation in the Game is personal; it is prohibited for the Participant to participate in the Game using third-party email addresses.

6.2.5 If it is found that a participant has submitted multiple entries for the same person or household, only the first entry will be validated and taken into account in the Game; the others will be considered null.

6.2.6 Registration of entries is continuous throughout the validity period of the Game. Only the exact time (hour/minutes/seconds) of the receipt of the registration of the participant's entry on the dedicated computer server for the Game, hosted by the provider chosen by the Organizing Company, shall prevail.

6.2.7 Any participation method other than that expressly provided for in these rules is excluded. Any participation in a form other than that provided for in these rules will not be considered and will be deemed null.

ARTICLE 7. WINNER SELECTION

The 5 (five) winners of the Game will be selected by random draw from all entries conforming to the provisions of these rules.

The draw for the Game will take place on 07/06/24.

The identity of the 5 (five) winners of the Game will be known and validated on the same day as the draw.

ARTICLE 8. PRIZES AND AWARDING OF PRIZES

8.1 Description of Prizes

Each winner of the Game will receive a set of 2 (two) dated Adult entry tickets to the Park, valid only during the Park's public opening season, on Park opening days and hours, excluding any other date (hereinafter the "Entry/Entries").

Each set has a unit value of forty-four Swiss francs including all taxes (CHF 44) VAT included.

The following expenses are not included in the aforementioned prize:

Round-trip transportation costs for the winner and/or accompanying person from their respective residence to the Park regardless of the mode of transportation used;

Parking fees at the Park;

Meals and beverages;

Personal expenses.

It is specified that in the event the Entry offered as a prize in the Game is used by a child, they may benefit from the rights conferred by this Entry at the Park. However, no one can claim any reimbursement of the price difference between the Park entry fee in force for an adult and the Park entry fee in force for a child. For the purposes of this article, "child" refers to individuals aged three (3) to eleven (11) years inclusive at the date of use of the Entry, and "adult" refers to individuals aged twelve (12) years and older at the date of use of the Entry.

If the winner is a minor, they must be accompanied by a person who can demonstrate parental authority to enjoy the prize.

The Organizing Company reserves the right, without its liability being incurred as a result, to modify the date of enjoyment of the aforementioned prize, notably depending on its operational constraints.

Only one set of Entries per winner will be awarded, with the specification that only one prize can be awarded per household (same name, same postal address).

8.2 Information Regarding Prizes

The prizes are non-transferable and cannot be exchanged. It is strictly prohibited to sell or exchange the prizes.

The prizes cannot be awarded in any form other than that provided for in these rules.

The prizes cannot be returned, exchanged, or replaced by another good or service for any reason whatsoever. No cash equivalent will be awarded in exchange for the prizes won.

The Organizing Company reserves the right to replace the prizes defined in Article 8.1 above with other prizes of equivalent value if circumstances require it, without the winners being entitled to any compensation or consideration of any kind as a result.

If the winner cannot or does not wish to benefit from the prize won for any reason whatsoever and, generally in the event of the winner waiving their prize, the winner loses the full benefit of their prize and cannot claim any compensation or consideration of any kind for this.

The prize will then be awarded to a substitute winner designated by random draw during the Game draw, in chronological order of the draw. The above-mentioned procedures will then be applied to the new winner.

8.3 Prize Award Procedure to Winners

The five (5) winners of the Game will receive, via email, to the email address they provided to the Organizing Company, in accordance with the provisions of Article 9, a voucher corresponding to the prize won (hereinafter the "Voucher").

Each winner must present the Voucher, printed on white paper and legibly, as well as a valid identity document, at the entrance of the Park on the day of the visit.

In exchange for the Voucher, the winner will receive the Park access tickets corresponding to their prize.

Any Voucher that is illegible, crossed out, torn, damaged, incomplete, partially printed, or falsified will not be accepted and will not entitle the participant to the prize. No compensation or consideration of any kind will be due to the participant for this.

ARTICLE 11. COMPLIANCE WITH GAME RULES

11.1 Participation in the Game implies the unconditional acceptance of these rules in their entirety, without condition or reservation.

11.2 The participant undertakes not to implement or seek to implement any process, of any nature whatsoever, likely to alter the proper functioning and/or conduct of the Game, as well as any process that would contravene the provisions of these rules.

11.3 The Organizing Company may, at its discretion, carry out any control operation to ensure compliance with these rules by any participant in the Game.

11.4 The Organizing Company reserves the right to cancel the participation in the Game of any participant who is the author of fraud, attempted fraud, abuse, and/or any act of any kind that would contravene these rules. In the event of the cancellation of a player's participation, this player forfeits all rights to the Game prize.

11.5 In any case, the Organizing Company reserves the right to pursue, by any means, anyone who contravenes these rules and/or disrupts the proper functioning and/or conduct of the Game. In the event of attempted fraud or fraud, the Organizing Company reserves the right, at any time, without prior notice or information to participants, to cancel the Game, to shorten it, to postpone it, or to modify its conditions, without its liability being incurred thereby in accordance with the provisions of Article 12.3.

ARTICLE 12. RESPONSIBILITIES

12.1 Regarding FACEBOOK's Responsibility

Since the Game is neither organized, managed, nor sponsored by FACEBOOK, FACEBOOK's responsibility cannot, under any circumstances, be engaged for anything related to the Game and/or these Game rules.

The Organizing Company's responsibility cannot, under any circumstances, be engaged, with regard to the participants, for decisions taken by FACEBOOK affecting or likely to affect the connection, access, availability, participation, dissemination, and, generally, the implementation of the Game on the Facebook platform hosting the Game application.

12.2 Regarding the Internet Network

Participation in the Game implies knowledge and acceptance by each participant of the characteristics and limits of the Internet network, including the functional characteristics and technical performance of the Internet network; problems related to connection and/or access to the Internet network and/or websites; problems related to the availability and congestion of networks; problems related to network failure or saturation; problems related to transit time, access to information posted online, response times to display, consult, query or otherwise transfer data; risks of interruption; lack of protection of certain data against possible diversion or hacking; risks of contamination by possible viruses circulating on said networks, etc., for which the Organizing Company cannot be held responsible.

The Organizing Company cannot be held responsible for:

  • any defect, error, interruption, delay in operation or transmission of data, communication breakdowns, loss, deterioration, destruction, deletion, theft, unauthorized access or modification of data;
  • technical problems preventing the correct routing of messages, non-delivery of emails,
  • sending messages and/or data to a false, incorrect, or incomplete address;
  • if the data relating to participation in the Game do not reach it, for any reason whatsoever, or if the data it receives are illegible or impossible to process;
  • if one or more participants are unable to access the Chaplin’s World Facebook Page and/or the Game, for any reason whatsoever;
  • in case a participant is unable to participate in the Game and/or to participate in it;
  • if, for any reason whatsoever, the participant's connection is interrupted or if their participation in the Game is not taken into account;
  • maintenance or malfunction of the Game server, the telephone network, or any other technical connection.

Furthermore, the Organizing Company declines all responsibility in the event of misuse of the terminal (computer, smartphone, tablet, etc.) and/or an incident related to the use of the terminal, access to the Internet network, the telephone line, or any other technical incident during or after participation in the Game. The Organizing Company cannot, in any case, be held responsible for any damage, of any nature whatsoever, caused to participants, their terminals, their computer and telephone equipment, and the data stored therein, nor for the consequences that may result on their personal, professional, or commercial activity resulting in any way from a connection to the Game site.

It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack or external source of origin. The connection of any person to the Chaplin’s World Facebook Page and participation in the Game is done at their sole, unique, and entire responsibility.

12.3 Special Provisions

The Organizing Company reserves the right, at any time, without prior notice or information to participants, to cancel the Game, to shorten it, to extend it, to postpone it, or to modify its conditions, notably in the event of the occurrence of a force majeure event or a fortuitous event, a malfunction attributable, among other things, to a computer virus, technical failure, bug, intervention, or unauthorized external intrusion on the computer system, fraud, or attempted fraud, including the use of a robot allowing the multiplication of the number of participations in the Game, or in the event of an event beyond the control of the Organizing Company likely to affect or compromise the proper management, security, fairness, participation procedure in the Game and/or the procedure for determining the winners, without its liability being incurred thereby.

Furthermore, the Organizing Company may, without its liability being incurred thereby, cancel the Game in the event of obvious fraud occurring, in any form whatsoever, and notably computer-related, in the participation procedure in the Game or the determination of winners.

In the event of the implementation of these provisions by the Organizing Company, the author of the fraud or attempted fraud will be immediately disqualified, and their participation in the Game will be canceled. They will forfeit all rights to the Game prize.

In any case, the Organizing Company reserves the right to pursue, by any means, all authors of these frauds.

In general, no compensation or consideration of any kind will be due to the participant(s) in the event of cancellation of the Game and/or modifications to the conditions of participation in the Game and/or designation of the Game winners.

ARTICLE 13. EVIDENCE AGREEMENT

The computerized records kept in the systems of the Organizing Company (or its duly authorized IT service provider(s)) in accordance with best practices in terms of security, shall be considered as evidence of email communications, submissions, and validation of participation. The archiving of these elements is carried out on a medium ensuring the faithful and durable nature required by the current legal provisions. It is agreed that in the event of a discrepancy between the computerized records of the Organizing Company or its IT service provider(s) and the documents in paper or electronic format available to the participant and/or the mere visitor, only the computerized records of the Organizing Company shall prevail.

ARTICLE 14. PUBLICITY / IMAGE RIGHTS OF WINNERS

Each winner expressly authorizes the Organizing Company to use their first name, last name(s), city, and department of residence in all communication messages related to the Game, regardless of the dissemination medium (internet, press, advertising, printed materials of any kind, etc.), published in Switzerland (subject to Internet support which implies worldwide dissemination) for a period of six (6) months from the date of the Game draw designating them as a winner, without this use entitling them to any remuneration, right, or advantage other than the award of the prize won.

However, this provision cannot be an obligation on the part of the Organizing Company.

ARTICLE 15. PROTECTION OF PERSONAL DATA

The personal data collected in the context of the Game are processed to enable the winners of the Game to receive their prizes.

These processing operations are based on the participant's consent.

The processing is carried out under the responsibility of the Organizing Company, represented by its chairman, whose contact details are mentioned in the above-mentioned Article 1.

The data collected are intended for:

The Organizing Company;

Service providers whose intervention is necessary for the realization of the processing mentioned above;

These data may be transferred to a country outside the European Union. The participant may obtain additional information on these transfers and the guarantees applicable to them from the Organizing Company.

Participation in the game does not involve any commercial reuse of participants' personal data, either by the Organizing Company or by third parties.

This data is kept for the following period:

Data collected for the delivery of prizes to winners.

The participant (or the parents - persons holding parental authority - of participants under 15 years of age who may act on behalf of their child, or accompany them in this process) has the right to access their data, to have it rectified or erased, to transfer it or have it transferred to a third party, to obtain limitation of processing, or to object to such processing. The Organizing Company will comply with their request subject to compliance with the legal obligations incumbent upon it. Requests made independently by persons under 15 years of age will also be taken into consideration.

The participant also has the right to withdraw their consent to the processing of their data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before such withdrawal.

Finally, the participant has the right to lodge a complaint with the Federal Data Protection and Transparency Commissioner if they believe that their rights are not being respected. ARTICLE 16. INTELLECTUAL PROPERTY RIGHTS RELATED TO THE GAME

In accordance with the laws governing literary, artistic, and industrial property rights in Switzerland, the reproduction, representation, and exploitation of all or part of the elements composing the Game are strictly prohibited. The mentioned trademarks are protected trademarks.

ARTICLE 17. ACCESS TO THE FULL REGULATION OF THE CONTEST

The complete regulations of the Game are available free of charge, in a printable format, on the Facebook Publication throughout the validity period of the Game.

ARTICLE 18. MODIFICATIONS TO THIS COMPLETE REGULATION

The Organizing Company reserves the right to modify, at any time, all or part of the provisions of this complete regulation without prior notice or information to the participants, especially in case of technical, legal, or jurisprudential developments, or when implementing new services.

Any modifications made by the Organizing Company to the provisions of this regulation will come into effect on the date of their publication on the Official Facebook Page of Chaplin's World. They will be considered as amendments to this regulation. The modifications made to this regulation are deemed accepted by the participants from the date of entry into force of said modifications, on the same terms as the initial version of this regulation or any previously modified version, as applicable.

In the event of a dispute or claim arising from a participant, the Organizing Company, or a third party regarding the Game, only the version of the regulation online as of the date on the Official Facebook Page of Chaplin's World shall be binding between the parties, regardless of the date of the disputed facts. The participant must regularly check the provisions of this complete regulation.

ARTICLE 19. REQUESTS AND CLAIMS

Any request, dispute, or claim relating to the Game and/or this regulation must be made in writing, within fifteen (15) calendar days from the date of the Game draw, to the address of the Game: BY GREVIN, Route de Fenil 2, - 1804 Corsier-sur-Vevey - Switzerland.

The Organizing Company will sovereignly settle any question relating to the application of this regulation or any question that may arise and is not addressed herein.

ARTICLE 20. APPLICABLE LAW AND JURISDICTION

This regulation is subject to Swiss law.

Any dispute or disagreement relating to the execution or interpretation of this regulation that could not be settled amicably between the parties shall be submitted to the competent courts of the Canton of Vaud.
