Complete Regulation of the Free Game without Purchase Obligation with Draw

 

Participation in the Game implies the unconditional and unreserved acceptance of these Rules in their entirety.

If, after becoming aware of the Rules, the participant does not accept the initial or modified provisions of these Rules, the Organizing Company invites the participant to promptly disconnect from the Game application.

ARTICLE 1. ORGANIZING COMPANY

BY GREVIN, a Swiss public limited company with a share capital of CHF 3,200,000, whose registered office is located at Route de Fenil 2, 1804 Corsier-sur-Vevey, Switzerland, registered with the Trade Register of the Canton of VAUD under number CH-660-0618000-4, operator of Chaplin’s World Museum (hereinafter the "Park"), is organizing a free game with no purchase necessary, called the Music Month Contest (hereinafter the "Game"), from 06/03/24 to 06/07/24 (Swiss connection date and time being authoritative).

The Game is neither organized, managed, nor sponsored by INSTAGRAM LLC. (hereinafter "INSTAGRAM"), operator of the social network Instagram (hereinafter "Instagram"), and therefore Instagram's responsibility cannot be sought by the participants.

ARTICLE 2. GAME VALIDITY PERIOD

The Game is organized from 06/03/24 to 06/07/24 at 11:59 PM, based on Swiss connection date and time.

ARTICLE 3. ACCESS TO THE GAME

3.1 Participation in the Game is free and with no purchase necessary. Therefore, it is not conditioned on any purchase or expense by the participant.

3.2 The Game is offered exclusively on the social network Instagram, on the official account of Chaplin’s World Museum managed by the Organizing Company: https://www.instagram.com/chaplins.world/ (hereinafter “Chaplin’s World Instagram Account”). The Game is only accessible via the Instagram post published on 06/03/24 on the Chaplin’s World Instagram Account (hereinafter “the Instagram Post”).

ARTICLE 4. GAME COMMUNICATION

The Game is announced on the following platform(s):

  • The Instagram Post of 06/03/24 published on the Chaplin’s World Instagram Account.
  • Story relays on the Chaplin’s World Instagram Account.

ARTICLE 5. PARTICIPANTS' CONDITIONS

5.1 The Game is open to any natural person aged fifteen (15) years or older. The participation of any minor in the Game implies that they have obtained express prior permission from their parents or legal guardian. The Organizing Company reserves the right to verify said authorization and to declare any participation null and void in the absence of such authorization.

5.2 To participate in the Game, the participant must:

  • Have access (fixed or mobile) to the Internet network.
  • Have a valid personal email address at which they can be contacted, if necessary, for the management of the Game.
  • Have a personal account on Instagram. Individuals without an Instagram account can create one according to Instagram's terms of use.

5.3 The following are expressly excluded from the Game:

  • Employees of the Organizing Company and companies belonging to the Organizing Company's group, as well as their immediate family members.
  • Any person who has directly or indirectly participated in the design, organization, realization, and/or management of the Game, as well as their immediate family members.

ARTICLE 6. PARTICIPATION PROCEDURES

6.1 Participation Procedure

To participate in the Game, the participant must, between 06/03/24 and 06/07/24 at 11:59 PM, based on Swiss connection date and time:

  • Log in to their personal Instagram account.
  • Log in to the Chaplin’s World Instagram Account to access the Instagram Post.
  • Follow the Chaplin’s World Instagram Account.
  • Leave a comment in the "comment" section of the Instagram Post.
  • (if applicable) Correctly answer the Game question in the "comment" section of the Instagram Post.
  • Click "publish" before 06/06/24 at 11:59 PM, based on Swiss connection date and time.

6.2 Conditions for Participation 6.2.1 Participation in the Game is subject to strict compliance with the steps described in Article 6.1 and registering the participant's entry before 06/06/24 at 11:59 PM, based on Swiss connection date and time.

6.2.2 Only one entry is allowed per person and per household (same name, same first name, same username) for the entire validity period of the Game.

6.2.3 Participation in the Game is personal.

6.2.4 If it is found that a participant has submitted multiple entries for the same person or household, only the first entry will be validated and taken into account for the Game; the others will be considered null.

6.2.5 Entries are continuously recorded throughout the validity period of the Game. Only the exact time (hour/minutes/seconds) of the receipt of the participant's entry on the computer server dedicated to the Game and hosted by the provider chosen by the Organizing Company is considered valid.

6.2.6 Any form of participation other than that expressly provided for in these rules is excluded. Any participation, in a form other than that provided for in these rules, will not be considered and will be deemed null.

ARTICLE 7. WINNER SELECTION

The winner of the Game will be selected by a random draw from all entries that comply with the provisions of Article 6.1 of these rules.

The draw for the Game will be conducted on 06/07/24. The identity of the Game winner will be known and validated on the same day as the draw.

ARTICLE 8. WINNER NOTIFICATION

Each winner of the Game will be personally informed of their prize and the procedures for obtaining it through a private message sent to their personal Instagram account by the Organizing Company, within a maximum period of five (5) business days following the date of the Game draw (i.e., no later than 06/14/24).

The winner will be asked to provide their first name, last name, and address to the Organizing Company within a maximum period of one (1) business day to enable the Company to deliver the prize won.

In the event of the winner not responding, for any reason, within the aforementioned period, or if the participant's contact details are false, incorrect, or invalid, or if the winner cannot or does not wish to receive the prize won for any reason, or in general, if the winner renounces their prize, the winner forfeits the entire benefit of their prize and cannot claim any compensation or consideration for it.

The prize will then be awarded to an alternate winner. The procedures described above will then apply to the new winner.

ARTICLE 9. PRIZES AND PRIZE AWARD

9.1 Prize Description

The winner of the Game will receive a Concert Pass as well as a set of 2 Adult entry tickets to the Park, valid only during the public opening season 2023-2024, on Park opening days and hours, excluding any other date (hereinafter the "Entry/Entries").

Each prize has a unit value of 94 CHFincluding all taxes (ninety four swiss francs including VAT).

The following expenses are not included in the aforementioned prize:

  • Round-trip transportation expenses for the winner and/or the accompanying person from their respective residences to the Park, regardless of the mode of transportation used.
  • Parking fees at the Park.
  • Meals and beverages.
  • Personal expenses.

It is specified that if the Entry offered as a prize for the Game is used by a child, they may benefit from the rights conferred by this Entry to the Park. However, no one can claim any refund of the price difference between the Park entry fee for an adult and the Park entry fee for a child. For the purposes of this article, "child" refers to all individuals aged three (3) to eleven (11) years old inclusive at the date of using the Entry, and "adult" refers to all individuals aged twelve (12) years and older at the date of using the Entry.

If the winner is a minor, they must be accompanied by a person who can prove parental authority to enjoy the prize.

The Organizing Company reserves the right, without being held responsible, to modify the date of enjoyment of the aforementioned prize, especially depending on its operational constraints.

Only one set of Entry/Entries per winner will be awarded, with the understanding that only one prize can be awarded per household (same name, same postal address).

9.2 Information Regarding Prizes

The prizes are personal and non-transferable. It is strictly prohibited to sell or exchange the prizes.

The prizes cannot be awarded in any form other than that provided for in these rules.

The prizes cannot be returned, exchanged, or replaced by another good or service for any reason. No cash equivalent will be awarded in exchange for the prizes won.

The Organizing Company reserves the right to replace the prizes defined in Article 9.1 above with other prizes of equivalent value, if circumstances so require, without the winners being entitled to any compensation or consideration of any kind as a result.

If the winner cannot or does not wish to receive the prize for any reason, or in general, if the winner renounces their prize, the winner forfeits the entire benefit of their prize and cannot claim any compensation or consideration of any kind for it.

The prize will then be awarded to an alternate winner designated by random draw during the Game draw, in chronological order of draw. The procedures described above will then apply to the new winner.

ARTICLE 10. PARTICIPATION VALIDITY CONDITIONS

10.1 The participant undertakes to provide accurate and complete information as part of their participation in the Game. The participant acknowledges and accepts that the information they enter to claim their prize if they are designated as the winner of the Game serves as proof of their identity. The information provided by the player as part of their participation in the Game is the player's responsibility from the validation of their participation.

10.2 Participants authorize all legal verifications regarding their identity and contact details. In case of false, erroneous, illegible, incomplete, inaccurate, or fanciful identity and/or address (postal and/or electronic) indications, the Organizing Company reserves the right, without prior notice or information, to cancel the participation of the concerned player and to delete or render impossible their access to the Game, without prejudice to any recourse or action it may take against the player.

10.3 The participant agrees not to use the surname, pseudonym, and/or email address of a third party and/or anything that could infringe upon the rights of third parties (including the use of the surname of a third party, the pseudonym of a famous or notorious person, the trademark of another, works protected by copyright, etc.). Under no circumstances shall the responsibility of the Organizing Company be engaged due to a participant's use of a term or sign that would usurp someone else's identity and/or infringe upon a right of ownership of any nature of which they are not the holder in the context of participating in the Game.

10.4 Any incomplete, illegible, crossed out, falsified, counterfeit, containing false information, not compliant with the conditions set out in these rules, not validated, or validated after the deadline for participation will be considered null.

10.5 Only participations compliant with the provisions of these rules will be taken into account in the Game.

ARTICLE 11. RESPECT FOR THE GAME RULES

11.1 Participation in the Game implies the unconditional acceptance of these rules in their entirety, without condition or reservation.

11.2 The participant agrees not to implement or attempt to implement any process, of any nature whatsoever, that could alter the proper functioning and/or the smooth running of the Game, as well as any process that would contravene the provisions of these rules.

11.3 The Organizing Company may, whenever it deems necessary, carry out any control operation to ensure compliance with the provisions of these rules by any participant in the Game.

11.4 The Organizing Company reserves the right to cancel the participation in the Game of any participant who would be the author of fraud, attempted fraud, abuse, and/or any act of any nature that would contravene the provisions of these rules. In the event of cancellation of a player's participation, this player is deprived of all rights to obtain the prize of the Game.

11.5 In any case, the Organizing Company reserves the right to prosecute, by any means, anyone who would contravene the provisions of these rules and/or alter the proper functioning and/or the smooth running of the Game. In the event of attempted fraud or fraud, the Organizing Company reserves the right, at any time, without prior notice or information to participants, to cancel the Game, shorten it, postpone it, or modify its conditions, without its liability being incurred thereby in accordance with the provisions of Article 12.3.

ARTICLE 12. RESPONSIBILITIES

12.1 Regarding Instagram's Responsibility

Since the Game is neither organized, managed, nor sponsored by INSTAGRAM, INSTAGRAM's responsibility cannot, under any circumstances, be engaged concerning the Game and/or these rules. The responsibility of the Organizing Company cannot, under any circumstances, be engaged towards participants for decisions made by INSTAGRAM affecting or likely to affect the connection, access, availability, participation, broadcasting, and, in general, the implementation of the Contest on the Instagram platform.

12.2 Regarding the Internet Network

Participation in the Game implies knowledge and acceptance by each participant of the characteristics and limits of the Internet network, including the functional characteristics and technical performance of the Internet network; problems related to connection and/or access to the Internet network and/or websites; problems related to the availability and congestion of networks; problems related to the failure or saturation of networks; problems related to transit time, access to online information, response times to display, consult, query, or otherwise transfer data; risks of interruption; absence of protection of certain data against possible diversion or hacking; risks of contamination by possible viruses circulating on said networks, etc., for which the responsibility of the Organizing Company cannot be engaged.

The Organizing Company cannot be held responsible for:

  • Defects, errors, interruptions, delays in operation or transmission of data, communication failures, loss, deterioration, destruction, deletion, theft, unauthorized access, or modification of data;
  • Technical problems preventing the correct routing of messages, non-delivery of emails;
  • Sending messages and/or data to a false, erroneous, or incomplete address;
  • If data related to participation in the Game does not reach it, for any reason whatsoever, or if the data it receives is illegible or impossible to process;
  • If one or more participants fail to access the Instagram Chaplin’s World Account, the Instagram Publication, and/or the Game, for any reason whatsoever;
  • In case of impossibility for a participant to participate in the Game and/or to participate in it;
  • If, for any reason whatsoever, the participant's connection is interrupted or if their participation in the Game is not taken into account;
  • Maintenance or malfunction of the Game server, the telephone network, or any other technical connection.

Furthermore, the Organizing Company declines all responsibility in the event of misuse of the terminal (computer, smartphone, tablet, etc.) and/or an incident related to the use of the terminal, access to the Internet network, the telephone line, or any other technical incident during or after participation in the Game. The Organizing Company cannot, under any circumstances, be held responsible for any damage, of any nature whatsoever, caused to participants, their terminals, their computer and telephone equipment, and the data stored therein, nor for the consequences that may result on their personal, professional, or commercial activity resulting in any way from a connection to the Game site.

It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any external attack or infringement. The connection of any person to the Instagram Chaplin’s World Account, the Instagram Publication, and/or the Game, and participation in the Game is at their sole, unique, and entire responsibility.

12.3 Special Provisions

The Organizing Company reserves the right, at any time, without prior notice or information to participants, to cancel the Game, shorten it, extend it, postpone it, or modify its conditions, notably in the event of the occurrence of force majeure or fortuitous event, malfunction attributable, among other things, to a computer virus, technical failure, bug, intervention, or unauthorized external intrusion on the computer system, fraud, or attempted fraud, including the use of a robot allowing the multiplication of participations in the Game or in the event of an event beyond the control of the Organizing Company likely to affect or compromise the proper management, security, fairness, the participation procedure in the Game and/or the procedure for determining the winners, without its liability being incurred thereby.

Furthermore, the Organizing Company may, without its responsibility being incurred thereby, cancel the Game in the event of blatant fraud occurring, in any form whatsoever, and notably computerized, in the procedure for participating in the Game or determining the winners.

In the event of the implementation of these provisions by the Organizing Company, the author of the fraud or attempted fraud will be immediately disqualified, and their participation in the Game canceled. They will be deprived of all rights to obtain the prize of the Game.

In any case, the Organizing Company reserves the right to prosecute, by any means, all authors of these frauds.

In general, no compensation or consideration of any kind will be due to the participant(s) in the event of cancellation of the Game and/or modification of the conditions of participation in the Game and/or designation of the winners of the Game.

ARTICLE 13. PROOF AGREEMENT

The computerized records kept in the systems of the Organizing Company (or its duly authorized IT service provider(s)) according to the rules of the art in terms of security, will be considered as evidence of email communications, dispatches, and validation of participation forms. The archiving of these elements is carried out on a medium ensuring the faithful and lasting character required by the current legal provisions. It is agreed that in the event of a discrepancy between the computerized records of the Organizing Company or its IT service provider(s) and the documents in paper or electronic format held by the participant and/or the mere visitor, only the computerized records of the Organizing Company shall prevail.

ARTICLE 14. PUBLICITY / IMAGE RIGHTS OF WINNERS

Each winner expressly authorizes the Organizing Company to use their first name, last name, city, and department of residence in all communication messages relating to the Game, regardless of the distribution medium (internet, press, display, printed matter of any kind, etc.), published in mainland France (subject to the Internet medium which implies global distribution) for a period of six (6) months from the date of the draw of the Game designating them as the winner, without this use entitling them to any remuneration, right, or advantage other than the award of the prize won.

However, this option shall not be an obligation on the part of the Organizing Company.

ARTICLE 15. PROTECTION OF PERSONAL DATA

Personal data collected is processed for the purpose of awarding the prize to each winner of the Game.

This processing is based on the participant's consent.

Providing the winners' first and last names is necessary for the Organizing Company to award them their prize.

The processing is carried out under the responsibility of the Organizing Company, represented by Mr. Fabrice LALLOUR, acting as General Manager, whose contact details are mentioned in the above-mentioned Article 1.

The collected data is intended for the Organizing Company.

This data may be transferred to a country outside the European Union. The participant can obtain additional information on these transfers and the guarantees that apply from the Organizing Company.

This data is kept for the following period:

until the prizes are awarded;

The participant has the right to access their data, to have it corrected or deleted, to transfer it or have it transferred to a third party, to obtain the limitation of processing or to object to such processing. The Organizing Company will comply with their request, subject to compliance with the legal obligations incumbent upon it.

The participant also has the right to withdraw their consent to the processing of their data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before such withdrawal.

They may be asked to provide a copy of an identity document indicating their date and place of birth and bearing their signature.

Finally, the participant has the right to lodge a complaint with the Federal Data Protection and Information Commissioner if they believe that their rights are not being respected. ARTICLE 16. INTELLECTUAL PROPERTY RIGHTS RELATED TO THE GAME

In accordance with the laws governing literary, artistic, and industrial property rights in Switzerland, reproduction, representation, and exploitation of all or part of the elements composing the Game are strictly prohibited. The mentioned trademarks are protected trademarks.

ARTICLE 17. ACCESS TO THE GAME RULES

The complete rules of the Game are available free of charge, in a printable format, on the Chaplin’s World Instagram Account throughout the validity period of the Game.

ARTICLE 18. MODIFICATIONS TO THIS COMPLETE REGULATION

The Organizing Company reserves the right to modify, at any time, all or part of the provisions of this complete regulation without notice or prior information to the participants, especially in the event of technical, legal, or jurisprudential developments or when implementing new services.

Any modifications made by the Organizing Company to the provisions of this regulation will come into effect on the date of their publication on the Chaplin’s World Instagram Account. They will be considered as amendments to this regulation. The modifications made to this regulation are deemed accepted by the participants from the date of entry into force of such modifications, in the same terms as the initial version of this regulation or the version previously amended, if applicable.

In the event of a dispute or claim arising from a participant, the Organizing Company, or a third party related to the Game, only the version of the regulation online on the Chaplin’s World Instagram Account on the date of the dispute will have binding force between the parties, regardless of the date of the disputed events. The participant must regularly check the provisions of this complete regulation.

ARTICLE 19. REQUESTS AND COMPLAINTS

Any request, dispute, or complaint relating to the Game and/or this regulation must be made in writing within fifteen (15) calendar days from the date of the Game's draw, to the address of the Game: BY GREVIN, Route de Fenil 2, – 1804 Corsier-sur-Vevey – Switzerland.

The Organizing Company will sovereignly settle any question relating to the application of this regulation or any question that arises and is not regulated by it.

ARTICLE 20. APPLICABLE LAW AND JURISDICTION

This regulation is subject to Swiss law.

Any dispute or disagreement relating to the execution or interpretation of this regulation that cannot be settled amicably between the parties will be submitted to the competent courts of the Canton of Vaud.
